His salary will not be 40 million. That just means he will be receiving 40 mill in year one.
At least half of that will be bonus. (ie does not count towards the cap).

its only going to be about 16mil towards the cap, the 40 mil is about 30 in signing bonus. this is how GM's work within the cap rules, giving a player a big signing bonus means their base salary can be lower
